Intent

Our contract is intended to accomplish a few simple goals. These goals are first, to provide the Buyers with our warranty on hereditary health problems. Second, to ensure that the Retrievers will always have a good home. Third, to ensure that the Retrievers are not used for breeding without health clearances. Fourth, to encourage the Buyers to provide Skoog Kennels with feedback on the Retrievers including health clearances.

The next set of  puppy shots is due on _________________. Based on our experience and upon the recommendation of our personal veterinarian, we use the product known as "Iverheart" as our heartworm preventative.


Price 

Skoog Kennels, referred to as Breeder, agrees to sell to the Buyer, a Chesapeake Bay Retriever, referred to as the Retriever, for $1500.00 plus any shipping/transportation expenses including the airfare, crate, and veterinarian's health certificate. A deposit of $750.00 has been received to reserve a Retriever. (Deposit will be refunded if no puppies are available.) If the Retriever is not paid for and picked up/shipped to within a reasonable time (by 3 months of age), the Breeder has the right to keep, sell or give away the Retriever. In the event of a returned check, the Buyer agrees to pay any and all bank fees associated with that returned check.  

Pickup/Shipping

As soon as is  reasonably possible after the Retriever is eight weeks of age, the Breeder will make the Retriever available to be picked up by the Buyer, or the Breeder will ship the Retriever to the Buyer by conveyance agreed to by the Breeder and the Buyer, and at a time reasonably convenient to the Buyer. The Breeder shall provide a shipping crate acceptable to the agreed conveyance, and the Buyer shall be responsible for all shipping expenses, including return of the shipping crate, which shall be paid in advance of shipping. In the event that the Retriever dies during shipping, the Breeder will refund 100% of the price of the Retriever plus shipping costs.


Registration papers  WILL NOT be shipped with the Retriever. The Breeder will forward registration papers to the Buyer within 30 days of the Buyer's receipt of the Retriever given that the Buyer has provided to the Breeder the information necessary to complete the AKC Registration form. 

Use of the Dog 

It is agreed between the Breeder and the Buyer that the Retriever is being acquired as a family companion dog or as a working dog to be used for tasks appropriate to its breed such as hunting, hunt test/field trials, search and rescue, therapy dog or for exhibition in AKC conformation, obedience, or agility competition. It is also agreed that the Retriever is not purchased for resale nor will it be used or trained for activities which are illegal or for which it is not suited by reason of temperament or conformation. Specifically, it will not be used as a guard or attack dog or to fight other animals. 


Registration 

The Retriever is being sold with Full Registration Rights. The Buyer agrees to register the Retriever with the American Kennel Club and if desired, the United Kennel Club. 


The Breeder does require the use of our kennel name, “Skoog’s" in your Retriever’s registered name.  This can either be as the prefix or suffix. 


In the interest in protecting the Chesapeake Bay Retriever Breed it is agreed that the Retriever will only be bred after each of the following conditions has been met:
  • the Retriever reaches minimum two (2) years of age;
  • Has been x-rayed  for hip dysplasia by a licensed veterinarian with film sent to OFA or Penn-Hip and has been certified clear of hip dysplasia with a Good or Excellent rating.
  • CERF rating of Clear to insure the animal is free of inherited eye defects. 

In the event the  Buyer chooses to breed the Retriever, the Buyer agrees that the Retriever will only be breed to Chesapeake Bay Retrievers that:
  • Are AKC, UKC or CKC registered.
  • Have been certified free of hereditary hip dysplasia or hereditary eye disease
  • Are of good temperament. 

If the Retriever is bred, accidentally or intentionally before he/she was genetically tested and certified clear, all guarantees are void. 

The Buyer agrees to not knowingly sell or dispose of any off spring of the Retriever to wholesalers, pet shops, or dog dealers. Failure to comply will result in the immediate forfeit of the Retriever and any of the Retriever's offspring still remaining  with the Buyer. 


Guarantee

Your Chesapeake Bay Retriever has been bred from temperamentally sound parents who have been X-Ray'd and evaluated by the Orthopedic Foundation for Animals (OFA) in the United States and have been found to be of the grade of "Good" or "Excellent" by the Orthopedic Foundation for and are free of canine hip dysplasia and that their eyes have been examined by a veterinary ophthalmologist and certified by Canine Eye Registration Foundation to be free from inherited eye disorders.   

It is understood that, at the time of sale, the Retriever has been evaluated by the Breeder with respect to other representatives of the breed at approximately the same age and has been determined to be structurally and temperamentally suited to be a companion, hunting, and/or obedience dog. This does not necessarily imply that the Retriever is of breeding or show quality. The Breeder warrants that the Retriever is a healthy, sound, quality Chesapeake Bay Retriever that is current on all vaccinations. The Breeder has provided the Retriever with the best possible health care, grooming, and socialization, so s/he is off to a great start as a family pet.

The Retriever has been examined by a veterinarian and has been inoculated with the appropriate vaccinations. Stool checks have been done on at least one occasion, and the Retriever has been treated if parasites were present. The Breeder will advise you of any continuing treatment that may be required.

The Buyer agrees to have a licensed veterinarian of their choice examine the Retriever within 7 days of purchase. If the Retriever is determined to be in ill health (parasites not included), the Breeder is to be notified within 24 hours and the Breeder will refund 100% of the purchase price, excluding any shipping costs, following the return of the Retriever and all papers to the Breeder, including a written statement from the attending veterinarian stating the dog's condition.

​The Retriever is guaranteed to be free of:
  • Bilateral hip dysplasia for the period of 26 months, defined for the purposes of this contract as OFA Moderate
or Severe PRA (Progressive Retinal Atrophy) for the period of 26 months. 
  • Hereditary/congenital defects for the period of 26 months that result in a significantly shortened lifespan and the accepted current veterinary medical therapies have failed to afford the dog an acceptable quality of life. 

Should the Retriever develop any of the mentioned health problems, a board certified veterinary specialist in the specific related field must send report to the Breeder before a replacement or refund is given. The Breeder reserves the right to have the Retriever checked by a veterinarian of choice, at the Breeder's expense, for the purpose of a second opinion prior to taking any of the remedies above. If any dispute arises as to the cause or validity of the diagnosis, both parties agree to select a third mutually agreed upon veterinarian specialist in the diagnosed problem to resolve the dispute. Expenses for such specialist consultation will be split evenly between the Breeder and the Buyer.

Upon agreement between the Buyer and the Breeder of the heath problem, the following resolutions are available:
  1. Refund 100% provided the living dog and registration papers are returned to the Breeder within two months after discovery of said defects; or
  2. Replace the dog with the next available like prospect or mutually agreeable animal, provided the live Retriever and registration papers a returned to the Breeder within two months after discovery of said defect; or
  3. The Buyer may decide to keep the Retriever if they so wish, thus assuming all future medical bills and other potential problems. However, as compensation, the Breeder will refund one half of the Buyer's original purchase price, excluding shipping/transportation costs once proof of neutering if a male or spaying if a female has been provided to the Breeder  by the veterinarian that performed the procedure. 

The Breeder will pay all shipping costs for the return of the living Retriever and the Buyer will pay all shipping costs for a replacement pup. If the Retriever is used heavily for field trialing, open obedience, hunting, or any other strenuous activity (including "roading") prior to its being one year of age, environmentally induced dysplasia and other joint problems may develop. If these factors occur, it is left to the Breeder discretion to honor this agreement. The Buyer should also educate himself to proper nutrition of the Retriever so as not to induce joint problems by either lack of nutrition or by causing an overweight condition in a developing dog.  The warranties concerning health, life, and condition are limited as expressed. The Breeder is not responsible for any payments of veterinarian's fees for examinations, drugs, X-rays, laboratory testing or any other treatment. This guarantee does not cover any injuries that are the result of trauma or mistreatment. This guarantee is not transferable should the Retriever be sold or given away by the Buyer unless the Retriever is specifically purchased as a gift and the recipient is named at the time of purchase. 

Return Policy

The decision to introduce a new puppy into your home is an important step for you and your family. While the benefits of pet ownership are many, these are balanced by new responsibilities that must be assumed by each family member. The Breeder recognizes that even after careful consideration, unforeseen circumstances may arise that prevent you from fulfilling these obligations. With concern for both you and the Retriever, if for any reason you find the puppy to be unsuitable to your situation, you may return the Retriever to the Breeder within 30 days of purchase for a refund less the original deposit.
 
The Buyer assumes all financial risk in the event that the Retriever is returned to the Breeder. If, for whatever reason, the Buyer cannot or does not wish to maintain custody of the Retriever, at any time during it's lifetime the Buyer agrees to contact the Breeder prior to selling the Retriever or placing the Retriever in another home to discuss placement arrangements. The Buyer agrees that under no circumstances will the Retriever be placed in a shelter. If the Retriever is found in an SPCA shelter, Humane Society, rescue program or the like, the Buyer agrees that all rights of ownership reverts to the Breeder and thereby the Breeder becomes the legal owner of the dog with all rights reserved and entitled to. 


Should, at any time, the Retriever be mistreated, abused or neglected, the Breeder reserves the right to take back immediate possession of the Retriever without reimbursement to the Buyer. The Buyer shall forfeit the AKC and UKC registration papers to the Breeder within 7 days of the Breeder taking possession of the Retriever.
 
Any Chesapeake Bay Retriever bought from the Breeder is always welcome back. No matter the age or situation. 

Responsibilities of the Buyer 

The Buyer agrees to provide the highest quality of care for the Retriever, including quality food, water, shelter from heat or cold; active companionship, appropriate exercise, socialization and professional veterinary care whenever necessary. Appropriate professional veterinary care includes, but is not limited to, annual exams, regular parasite checks and worming if necessary, vaccinations as recommended by local protocol, and regular heartworm preventative.

The Buyer agrees to maintain preventive care of the Retriever in regards to Hip Dysplasia and other skeletal diseases, such as proper nutrition (including avoiding excessive nutrition), proper exercise and preventing stress injuries. 
Buyer shall provide the Retriever with humane care and maintain it in accordance with all current and future state, county and municipal laws where buyer resides. The Buyer agrees to provide a suitable environment for the Retriever and will not allow it to run loose in an unsupervised situation. The Buyer further agrees that the Retriever will never, at anytime, be chained, tied to a stake or otherwise tethered unsupervised outside. 

By signing below, the Buyer signifies they have been instructed by the Breeder that socialization is extremely important in the proper rearing of a Chesapeake Bay Retriever puppy in order for it to become a stable adult dog. The Buyer makes absolute promise that the Retriever shall receive socialization with people and other dogs. The Buyer agrees to provide the Breeder with reports on the Retriever made by telephone, e-mail or letter.
Financial and Legal Obligations

The Buyer agrees that the Buyer is solely responsible for all costs and expenses of and related to the ownership of the Retriever including but not limited to feeding, veterinary care and training.

The Buyer further agrees that the Buyer is waiving all rights to sue the Breeder for injury (bodily or property) caused by the Retriever, and that the Buyer will indemnify and hold the Breeder harmless against all claims against the Breeder for injury (bodily or property) brought by a third party. 

In the event that litigation is commenced to enforce any of the terms of this Agreement, the Buyer agrees that the Breeder shall be entitled to the costs of reasonable attorney's fees and expenses and that the Contract will be interpreted according the laws of the State of Indiana and that any litigation must be filed in Indiana.
By signing of this Contract of Sale, the Buyer accepts all conditions contained herein.

Skoog Kennels reserves the right to refuse sale of any Chesapeake Bay Retriever to anyone we deem unqualified as an owner. This decision is based on the well being of the Retriever. None will be placed or RETURNED to neglectful or abusive homes and if found to be so, Skoog Kennels will retain FULL ownership of neglected/abused dog.
